Proposed legislation would make it a crime not to disclose possession of concealed weapon to police

Please be advised that a proposed legislation has been introduced by Rep. Chris England, D-Tuscaloosa, which would make it a crime for those who refuse to disclose to law enforcement that they possess a concealed weapon. The violators would be charged with a Class A misdemeanor, which would carry a sentence of up to one year in prison.

To provide context, the Alabama Legislature passed a law in 2022 permitting the carry of concealed weapons without a permit. However, individuals with firearms are required to disclose that information to law enforcement officers upon request. Nonetheless, Alabama Attorney General Steve Marshall stated in an opinion that failure to disclose without a specific penalty provision could be unenforceable.

It is expected that lawmakers will consider England's bill during their session, which is scheduled to begin in early February.
